To confirm custody or obtain an official record, contact the sheriff's office, jail, clerk, court, corrections department, or other office that created or holds the record. Texas Government Code Chapter 552 may apply to government-held public information, but that law does not make this private site an official custodian.
Commercial Mugshot Issues
Texas Business & Commerce Code Section 109.0045 addresses certain commercial publications of criminal-record information and correction or removal procedures. Texas Business & Commerce Code Chapter 17 contains the state's Deceptive Trade Practices and Consumer Protection provisions. Those statutes are not promises that an official law-enforcement booking photo must be removed on request. Official records, court orders, expunctions, and commercial publisher practices are separate issues.
